Rocky Seas Ahead-- Captain & Tennille File for Divorce

The pop duo that believed love would keep them together has filed for divorce.

Captain and Tennille, aka Daryl Dragon and Cathryn Tennille, have filed for divorce after nearly 39 years of marriage.

The duo that put out hits such as "Muskrat Love" and "Love Will Keep Us Together," filed for divorce on Jan. 16 in Prescott, AZ.

The Captain received his nickname when he was a member of the Beach Boys.  The duo has been together since 1972.

Arizona is a Community Property state, which is different from Maryland law, in that the divorce laws of Arizona assume that all property acquired during the marriage is equally owned by each partner regardless of how it was acquired.

Maryland is an equitable property state, which means that property first has to be determined to be part of the marriage.  Property can be excluded if special circumstances or precautions are made to ensure that the property is only the property of the one spouse.

Other than the determination of what is marital property, the two states operate similiarly in that the property will be valued and then distributed fairly and equitably.  Neither Arizona or Maryland require property to be divded equally.

These laws also apply to debts, as well.  Even if your husband rang up a large credit card bill, you might be liable for that debt too.  Often times bankruptcy follows a divorce in order to clear marital debts.

I am sure the couple will need to "Shop Around" for the right attorney to get them through this process.
